Terms & Conditions

The following terms have the following meanings:

Booking Period – the length of the rental period as set out in the Booking Confirmation

Property or Laburnum Cottage – Laburnum Cottage, Green Lane, Ashmore, Dorset SP5 5AQ

You/you – the person named in the Booking Confirmation and all other persons referred to in the Booking Confirmation

We/us – Gilly Forge of Acorn Cottage, Green Lane, Ashmore, Dorset SP5 5AQ

 

Please read all of these terms and conditions before confirming your booking

Your contract with us will begin when we send You a Booking Confirmation and will be on the terms set out in these Terms and Conditions and the additional terms, including as to payment and cancellation, set out in your Booking Confirmation.

 

Providing the Property and restrictions

We will provide the Property to You for the Booking Period.   If you do not pay Us for the Property as set out in the Booking Confirmation You will not be permitted access to the Property.

Only the number of people referred to in the Booking Confirmation may use the property.

Smoking/vaping is strictly prohibited inside the property.

 

The Property and adjoining and neighbouring properties are thatched.  No naked flame (other than use of the internal wood fire using the wood provided) is permitted inside or outside the property.  In particular, no barbecues, Chinese or other lanterns, fireworks or any similar item may ever be used at or near the property.

 

Payment and Cancellation.
A payment for the booking should be made when we send you the Booking Confirmation.
If the start date of the booking period is less than eight weeks before the occupancy, the full amount of the price must be paid at the time of booking.
Subject to the preceding paragraph, you must pay a deposit of a minimum of 50% of the total cost of the booking at the time of confirmation.
You may cancel a Booking for the Property up to 8 weeks before the start date for occupancy by contacting us by email, and we will refund you the deposit.
If you cancel a Booking for the Property less than 8 weeks before the start date for the Booking Period and we are unable to secure another booking for the Property to another party, we reserve the right to retain your deposit as outlined in the Booking Confirmation.
If you cancel, we will endeavour to re-let the property, and if successful, we will return to you all sums received by us.

Damage

Please treat the Property with care and as if it is your own.  You accept responsibility for any theft, breakage or damage or loss (including loss of keys) caused by you, pets or any member of your party and agree to indemnify Us for any loss that we may incur as a result.

If there has been any damage or breakage during your stay you should let us know as soon as you can and before you leave.

We will check the Property after you leave and inform You of any amount payable by You for any loss or damage.  You must pay Us for any loss or damage arising from your stay and we may take payment for such from any deposit we have requested from You.

 

Dogs

If agreed in advance and set out in the Booking Confirmation you may bring in total up to two domestic pet dogs to the Property.  Any dog must be kept off all furniture and kept under proper control.  The garden is fenced but you must take care to ensure that any dog does not escape.  The Property is in a village close to livestock and any dog must be kept under control.

 

Internet

We provide internet access for recreational use.  This is provided by a local company which supplies many local properties but we will not be liable for any form of compensation whatever arising from internet access being restricted or not available.

You should note that mobile phone coverage in the Property and the surrounding area is limited.

 

Parking

Please use the parking space adjoining the Property.  If you need space for more than one care You must let us know in advance.

 

Access

We and our contractors may need access to the Property during your stay.  If this is needed we will try to let you know in advance and will try to minimise disruption.  It is likely that routine work will be undertaken in the garden of the Property.

 

Other important terms

Please respect the neighbours/community and keep noise levels to a minimum, especially between 10pm and 8 am.

We only supply the Property for short term private domestic holiday use.  No landlord and tenant relationship is created under or in relation to this agreement and you will not have any rights to a tenancy of any kind or protection whether under the Housing Act 1988 or other security of tenure provisions.

Any problem or complaint should be reported to Us directly and immediately in person, by telephone or email and we will endeavour to correct any problems.  We will not be able to consider any problem reported after you leave the Property.

You are responsible for your own property and that of any visitor or member of your party and we will have no liability for the loss or damage to such property.

Our liability to you and to anyone accompanying you at the Property is strictly limited to direct loss up to the amount paid by you, but this does not apply to our liability for:

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation by us
  • Anything else for which liability may not by law be excluded.

We shall not be liable to you at all for any indirect or consequential loss, whether caused by negligence, breach of contract or otherwise.

We reserve the right to terminate occupation of the Property at any time if the terms and conditions of this agreement are not complied with in full or in party.

Law and jurisdiction

This agreement is governed by English law and is subject to the exclusive jurisdiction of the English courts.  You and all persons to whom this agreement relates submit to the exclusive jurisdiction of the English courts.
